Un plan de patrimonio básico se compone de una última voluntad y testamento, una directiva médica avanzada y un poder notarial. La mayoría de los estudiantes universitarios nunca consideran establecer un testamento y una última voluntad porque no están casados, no tienen hijos y no creen que tengan algo de valor que dejar atrás. Si bien esto puede ser cierto, a menudo se olvidan de sus otros activos valiosos, como automóviles, cuentas bancarias, teléfonos inteligentes / computadoras, medios digitales e incluso cuentas de redes sociales y contraseñas.

Si un individuo muere intestado (sin un testamento), su dinero y otras posesiones se dividen y distribuyen de acuerdo con las leyes de intestado que pueden no reflejar sus deseos. Por ejemplo, estas leyes distribuyen toda la propiedad a familiares cercanos, excluyendo completamente a familiares y amigos lejanos. Esto puede ser desafortunado si la persona no tiene una relación cercana con su familia inmediata y hubiera preferido que sus amigos fueran beneficiarios.

Directiva avanzada

Si bien algunos estudiantes universitarios pueden confiar en que sus padres podrían tomar las mejores decisiones médicas en su nombre, es importante comprender que los padres pierden el derecho de tomar estas decisiones y acceder a los registros de atención médica de sus hijos después de cumplir los dieciocho años. Además, la Ley de Portabilidad y Responsabilidad de Seguros de Salud de 1996 (HIPAA) prohíbe el intercambio de información médica a personas no autorizadas. Por lo tanto, es necesario establecer un plan de atención médica y nombrar a un agente de atención médica con anticipación ya que la situación puede ser extremadamente complicada y angustiosa.

Poder Notarial

Finalmente, un poder notarial le permite a una persona, conocida como el “principal”, asignar un agente para administrar sus asuntos legales y financieros si no pueden hacerlo. Un poder notarial mantiene el poder del director para actuar y define los límites del poder otorgado al agente. Para los estudiantes universitarios, un poder notarial puede ser beneficioso si les gustaría que sus padres o tutores les ayuden con la banca, obteniendo préstamos, firmando un contrato o cualquier otro asunto legal o financiero mientras están fuera de la universidad o incluso estudiando en el extranjero.
