Lo que debe saber sobre fideicomisos revocables

La planificación patrimonial es imprescindible para todos los adultos. Para prepararse adecuadamente para la muerte o incapacidad de uno, es muy beneficioso comprender las herramientas y los documentos que pueden componer un plan patrimonial integral. Reconocer los términos y estipulaciones de un fideicomiso en vida revocable puede ser de gran ayuda al determinar cómo asignar y distribuir activos. Un fideicomiso revocable puede o no ser la opción perfecta para su plan patrimonial (quizás un fideicomiso irrevocable se adapte mejor a sus necesidades), pero es igualmente importante comprender las funciones de este tipo de fideicomiso.

1. Los fideicomisos revocables pueden actualizarse con el tiempo.

El fideicomitente o otorgante es responsable de crear los términos del fideicomiso y de determinar qué activos se incluirán en el fideicomiso. Las disposiciones de un fideicomiso revocable pueden revisarse y actualizarse en cualquier momento durante la vida del otorgante. Este es un alojamiento ideal para alguien que espera cambios importantes en la vida en los años siguientes, o le gustaría revisar los términos de la confianza a medida que avanza en la vida. Por ejemplo, alguien que no está casado y no tiene hijos (y espera ambos en el futuro) podría hacer uso de un fideicomiso revocable. 2. Tras la muerte, el fideicomiso revocable no puede revisarse más.

Cuando el otorgante fallece, el fideicomiso se convierte automáticamente en un fideicomiso irrevocable, lo que significa que los términos y el contenido del fideicomiso ya no se pueden cambiar. Las disposiciones del fideicomiso entran en vigencia luego de la muerte del otorgante. En esta etapa, el administrador es responsable de distribuir el contenido del fideicomiso, que puede incluir cuentas financieras, bienes raíces y otros activos. Los activos se dispersan entre los herederos nombrados en el fideicomiso. Un administrador también está autorizado para administrar artículos en el fideicomiso si el otorgante queda incapacitado.

También vale la pena señalar que los fideicomisos vivos no están sujetos a legalización tras la muerte del otorgante. Esto minimiza el tiempo y los recursos que de otro modo se gastarían en la corte estatal de sucesiones para determinar la distribución de los activos.

3. Un fideicomiso revocable no es la única solución para la planificación patrimonial.

Incluso con un fideicomiso de vida revocable bien desarrollado, otros documentos de planificación patrimonial son esenciales. Las directivas avanzadas, por ejemplo, se centran en las preferencias de tratamiento médico. En caso de una emergencia médica incapacitante, una directiva avanzada le permitirá cumplir sus deseos y le permitirá a un agente designado tomar decisiones médicas en su nombre.

Un fideicomiso vital irrevocable tiene sus propios beneficios, como la seguridad de los acreedores y los impuestos sobre el patrimonio. Es posible que los términos de un fideicomiso irrevocable sean ideales para su situación particular.

Un testamento es otro documento que cubrirá terreno importante y protegerá sus deseos. Esto permitirá la distribución de bienes y activos que no se mantengan en un fideicomiso, preferencias importantes de tutela y cuidado de mascotas, y otros deseos finales específicos.
