Estate Planning for Women of Color: Changing the Narrative

For far too long, estate planning has been marketed in ways that quietly suggested it was not meant for women of color. The imagery, the language, and the assumptions often reflected a narrow vision of who “belongs” in the conversation—wealthy, privileged, and far removed from the lived experiences of many families.

That message—subtle or explicit—has had consequences. It has left many women of color feeling unseen, excluded, or uncertain about whether estate planning is relevant to their lives.

Why This Work Is Personal

My name is Elsa W. Smith, and I am a Maryland estate planning and probate attorney. My work and educational outreach intentionally center women of color because representation is not symbolic—it is practical. When people see themselves reflected in professional guidance, they are more likely to engage, ask questions, and take action.

Estate planning touches the most personal aspects of life: family, care, responsibility, and legacy. Those conversations deserve cultural awareness, respect, and understanding. My practice is grounded in a simple but powerful mission: to empower women through estate planning.

Confronting Harmful Assumptions

Historically, women of color have been excluded from estate planning conversations because of harmful and inaccurate assumptions—that we lack wealth, lack assets, or lack the need to plan.

These assumptions ignore reality. They also obscure an important truth: estate planning is not reserved for the wealthy. It is for anyone who wants a voice in what happens to their health, their property, and their loved ones.

When planning is framed as a luxury rather than a necessity, entire communities are discouraged from protecting themselves. Challenging that framing is essential to changing outcomes.

The Truth About Legacy and Responsibility

Women of color are homeowners, professionals, entrepreneurs, caregivers, and leaders within families and communities. We provide support across generations. We manage resources. We make decisions that shape the stability and well-being of those we love.

Those responsibilities create legacy—regardless of net worth.

Estate planning ensures:

  • Someone you trust can make medical and financial decisions if you cannot

  • The people you love are protected and supported

  • Your property passes according to your wishes

  • Your family is not left to navigate uncertainty alone

Legacy is not measured only in dollars. It is measured in care, intention, and preparation.

Estate Planning as Empowerment

Estate planning is an act of self-advocacy. It allows women of color to claim authority over their futures and provide structure for their families. It replaces uncertainty with clarity and assumption with direction.

When women of color engage in estate planning, they are not simply completing documents—they are:

  • Defining their voice

  • Protecting their autonomy

  • Strengthening family stability

  • Creating intergenerational security

Planning is power. Preparation is protection.

Changing the Conversation

Changing the narrative requires visibility, education, and access. It means speaking directly to communities that have historically been overlooked and affirming that their stories, their families, and their futures matter.

Every educational resource, presentation, and client conversation is an opportunity to reshape expectations—to make estate planning approachable, relevant, and empowering.

When more women of color see estate planning as a tool available to them, barriers begin to fall. Confidence grows. Protection becomes possible.
